Resolution Rescinding Legislative Authorization RE: Participation in the "Conference of States"
Applicability: To be introduced in those states that did, in 1995, pass resolutions of support for participation in a proposed "Conference of States." (ARIZONA, ARKANSAS, DELAWARE, IDAHO, IOWA, KENTUCKY, MISSOURI, NEBRASKA, OHIO, SOUTH DAKOTA, TENNESSEE, UTAH, VIRGINIA, and WYOMING.)
Resolution Rescinding Legislative Authorization RE: Participation in the "Conference of States"
WHEREAS, on (DATE), 1995, the Legislature of this State passed (resolution #), which authorized this state’s participation in the "Conference of the States;" and
WHEREAS, since that time the following state legislatures have considered participating in the Conference of the States and have resolved not to participate in same because there is a legitimate danger that said conference could convert into or precipitate a constitutional convention: California, Georgia, Hawaii, Kansas, Maryland, Mississippi, Montana, New Hampshire, New Mexico, North Dakota, Oklahoma, Rhode Island, and West Virginia;
WHEREAS, the City of Philadelphia, the host city for the Conference of the States, voted unanimously on March 16, 1995, to send a resolution to the Pennsylvania State Legislature requesting that it reject the Conference of the States;
WHEREAS, this Legislature favors the decentralization of power from the federal Government to the States;
WHEREAS, in light of the foregoing, and the rejection of the Conference of the States by the aforementioned States and the City of Philadelphia, it is incumbent upon this Legislature to further consider whether to provide this State’s legislative sanction to the Conference of the States;
IT IS THEREFORE RESOLVED that (resolution #) passed by this Legislature on (date), 1995 authorizing this state’s participation in the Conference of the States be, and hereby is, rescinded; and
IT IS FURTHER RESOLVED that a certified copy of this resolution be forwarded to the Governor.
